The Menendez Brothers Case: A Timeline
Prosecutors in Los Angeles have stated that they will request a court to reconsider the sentence of Lyle and Erik Menendez on Friday. The brothers were convicted of killing their parents in 1989 and are currently serving life sentences without the possibility of parole. Los Angeles County District Attorney George Gascón has affirmed that there is no doubt that the brothers killed their parents in Beverly Hills, a fact that the brothers have acknowledged. However, the brothers maintain that they acted in self-defense after years of abuse at the hands of their father. Gascón is now reconsidering the case. Gascón stated that a renewed understanding and empathy for victims of sexual abuse make it appropriate to reexamine the case. The brothers were convicted and sentenced in 1996. The case has resurfaced in the public eye following a docuseries and a true-crime drama released by Netflix. Here’s a look at the timeline of the case: August 1989 Jose Menendez, an executive at RCA Records in Los Angeles, and his wife Kitty Menendez, were shot and killed in their Beverly Hills mansion. March 1990 Lyle Menendez, then 21, was arrested. Eighteen-year-old Erik Menendez turned himself in a few days later. They were accused of first-degree murder. July 1993 The Menendez brothers went on trial, each with a separate jury. Prosecutors argued that they killed their parents for financial gain. The brothers’ attorneys did not dispute that the pair killed their parents but argued that they acted out of self-defense after years of emotional and sexual abuse by their father. January 1994 Both juries reached a deadlock. October 1995 The brothers’ retrial began, this time with a single jury. Much of the defense evidence about alleged sexual abuse was excluded during the second trial. March 1996 Jurors convicted both brothers of first-degree murder. July 1996 The brothers were sentenced to life in prison without the possibility of parole. May 2023 Attorneys for the Menendez brothers asked the court to reconsider the conviction and sentence in light of new evidence from a former member of the boy band Menudo, who said he was raped by Jose Menendez when he was 14. In addition, they submitted a letter that Erik wrote about his father’s abuse prior to the killings. September 2024 Netflix released the crime drama a nine-episode series about the killings. Oct. 4, 2024 Gascón said his office is reviewing new evidence in the case. Oct. 16, 2024 Multiple generations of family members of the Menendez brothers held a news conference . The relatives say the jurors who sentenced them to life without parole in 1996 were part of a society that was not ready to hear that boys could be raped. Biden to Express Regret Over 150-Year Indian Boarding School Policy
(NORMAN, Okla.) — President Joe Biden is expected to formally apologize on Friday for the country’s role in the Indian boarding school system, which devastated the lives of generations of Indigenous children and their ancestors. “I would never have guessed in a million years that something like this would happen,” said Secretary of Interior Deb Haaland, a member of the Pueblo of Laguna. “It’s a big deal to me. I’m sure it will be a big deal to all of Indian Country.” Shortly after becoming the first Native American to serve as Secretary of Interior, Haaland launched an investigation into the boarding school system, which found that at least 18,000 children, some as young as 4, were taken from their parents and forced to attend schools that sought to assimilate them, in an effort to dispossess their tribal nations of land. It also documented nearly 1,000 deaths and 74 gravesites associated with the more than 500 schools. No president has ever formally apologized for the forced removal of Native American, Alaska Native, and Native Hawaiian children — an element of genocide as defined by the United Nations — or any other aspect of the U.S. government’s decimation of Indigenous peoples. During the second phase of its investigation, the Interior conducted listening sessions and gathered the testimony of survivors. One of the recommendations of the final report was an acknowledgement of and apology for the boarding school era. Haaland said she took that to Biden, who agreed that it was necessary. Haaland, whose grandparents were forced to attend a boarding school, said she was honored to play a role, along with her staff, in helping make the apology a reality. Haaland will join Biden during his first diplomatic visit to a tribal nation as president on Friday as he delivers his speech. “It will be one of the high points of my entire life,” she said. It’s unclear what, if any, action will follow the apology. The Department of Interior is still working with tribal nations to repatriate the remains of children on federal lands, and many tribes are still at odds with the U.S. Army Corps of Engineers, which has refused to follow the federal law regulating the return of Native American remains when it comes to those still buried at Carlisle Indian School in Pennsylvania. “President Biden’s apology is a profound moment for Native people across this country,” Cherokee Nation Principal Chief Chuck Hoskin Jr. said in a statement to The Associated Press. “Our children were made to live in a world that erased their identities, their culture and upended their spoken language,” Hoskin said in his statement. “Oklahoma was home to 87 boarding schools in which thousands of our Cherokee children attended. Still today, nearly every Cherokee Nation citizen somehow feels the impact.” Friday’s apology could lead to further progress for tribal nations still pushing for continued action from the federal government, because it’s an acknowledgement of past wrongs left unrectified, something “known and buried,” said Melissa Nobles, Chancellor of MIT and author of “The Politics of Official Apologies.” “These things have value because it validates the experiences of the survivors and acknowledges they’ve been seen and we heard you, and also there’s a lot of historical evidence to suggest this happened,” Nobles said. In Canada, a country with a similar history of subjugating Indigenous peoples and forcing their children into boarding schools for assimilation, an apology from Prime Minister Justin Trudeau in 2017 was followed by the establishment of a truth and reconciliation process and the injection of billions of dollars into First Nations to deal with the devastation left by the government’s policies. No such commission exists in the U.S. A bill to establish a truth and reconciliation process was introduced last year by Sen. Elizabeth Warren, but it remains in the Senate. Pope Francis issued a historic apology in 2022 for the Catholic Church’s cooperation with Canada’s “catastrophic” policy of Indigenous residential schools, saying the forced assimilation of Native people into Christian society destroyed their cultures, severed families and marginalized generations. “I am deeply sorry,” Francis said to school survivors and Indigenous community members gathered in Alberta. He called the school policy a “disastrous error” that was incompatible with the Gospel. “I humbly beg forgiveness for the evil committed by so many Christians against the Indigenous peoples,” Francis said. In 1993, President Bill Clinton signed a law apologizing to Native Hawaiians for the overthrow of the Hawaiian monarchy a century prior. In 2008, Australian Prime Minister Kevin Rudd formally apologized to Aboriginal and Torres Strait Islander peoples for his government’s past policies of assimilation, including the forced removal of children. New Zealand Prime Minister Jacinda Ardern made a similar concession in 2022. Trump Vows to Dismiss Special Counsel Jack Smith Immediately Upon Re-election
(WASHINGTON) — Former President Donald Trump said Thursday that if he wins the White House, he will fire special counsel Jack Smith “within two seconds” of taking office. Trump was asked during an interview with conservative radio host Hugh Hewitt whether he would first pardon himself or terminate Smith to remove the legal cloud hanging over him. Smith, who was appointed by Attorney General Merrick Garland in 2022, has charged the former president over his efforts to overturn the 2020 election and his mishandling of classified documents. “It’s so easy. I would fire him within two seconds,” Trump responded. “He’ll be one of the first things addressed.” Trump, who regularly assails Smith and has suggested before that he would fire him if he were president, called Smith a “crooked person.” Trump, if elected, could order the Justice Department to remove Smith. Trump probably would not be able to do it on his own because Smith is not a presidential appointee. When Trump, while president, was investigated by special counsel Robert Mueller, Trump urged his then-White House counsel, Don McGahn, to press the Justice Department to terminate Mueller. McGahn refused. Smith has brought two federal cases against Trump. One, accusing him of illegally retaining classified documents at his Mar-a-Lago estate in Florida, was dismissed in July, a decision that Smith is appealing. The other, charging him with plotting to overturn the 2020 presidential election, has been delayed by a Supreme Court opinion that blocked the release of some documents Trump made while president. After Trump said he would fire Smith, Hewitt raised the possibility that Congress could impeach Trump over that move. Trump said he did not believe that would happen. “I don’t think they’ll impeach me if I fire Jack Smith,” Trump said. “Jack Smith is a scoundrel.” Democrat Kamala Harris’ campaign has sought to use revelations from Smith’s investigations into Trump against the Republican candidate. CDC Recommends Pneumococcal Vaccine for Adults 50 and Older
NEW YORK — U.S. health officials have recommended that people aged 50 and older receive a vaccination against bacteria that can cause pneumonia and other serious illnesses. The recommendation, made by a scientific advisory panel and approved by the Centers for Disease Control and Prevention (CDC), lowers the minimum recommended age for older adults to receive the shot from 65. “Now is an ideal time to get vaccinated against pneumococcal disease in preparation for the winter respiratory season,” CDC Director Dr. Mandy Cohen stated Wednesday night. The advisory committee voted 14-1 to implement the change during a meeting earlier in the day in Atlanta. This guidance is widely followed by doctors and prompts health insurers to cover the cost of recommended vaccinations. Pneumococcal vaccination recommendations are sometimes considered the most complex vaccination guidance issued by the government. The CDC currently recommends the vaccine for children under 5 and adults aged 65 or older, as long as they have not previously been vaccinated against pneumococcal disease. Officials also advise vaccination for children and adults at increased risk for pneumococcal disease, such as those with diabetes, chronic liver disease, or a compromised immune system. There are over 100 recognized types of pneumococci bacteria, which can cause severe infections in the lungs and other parts of the body. The U.S. experiences approximately 30,000 cases of invasive pneumococcal disease annually, including blood infections, brain and spinal cord inflammation, and other illnesses. About 30% of cases occur in individuals aged 50 to 64. The first pneumococcal vaccine was licensed in the U.S. in 1977. Since then, pharmaceutical companies have developed newer versions that target a dozen or more types in a single dose. Different vaccines have come and gone, including Pfizer’s Prevnar 13, which was once a top seller but is no longer available. Currently, four vaccines are in use. This year, the U.S. Food and Drug Administration approved the newest—Merck’s Capvaxive, which can cost around $300 per dose and protects against 21 types, including eight not covered by other pneumococcal vaccines. A Merck spokesperson stated that it was specifically designed to help protect against the bacteria types responsible for the majority of severe illness in adults aged 50 and older. In June, the CDC advisory panel recommended the vaccine as an option for adults at higher risk. The committee also discussed the possibility of lowering the age recommendation for older adults. They noted that illness-causing infections peak at ages 55 to 59 in Black Americans—a younger age than observed in white individuals. However, the committee deferred this decision until this week's meeting. Some concerns remain: A booster shot may be required, potentially in about 15 years. Additionally, some new vaccines are in development, which could necessitate further updates to the recommendations. “Pneumococcal vaccination recommendations have been quite confusing for many years, and it's challenging to have a new recommendation every two or three years,” said Dr. Jamie Loehr, chair of the committee’s pneumococcal working group.
