THE Supreme Court (SC) issued on Tuesday, September 27, 2022, a stern warning against those who incite violence through any means that put the lives of judges and their families in danger.“The Court STERNLY WARNS those who continue to incite violence through social media and other means which endanger the lives of judges and their families, and that this SHALL LIKEWISE BE CONSIDERED A CONTEMPT OF THIS COURT and will be dealt with accordingly,” the SC said.The SC issued the statement following the social media posts made “by a certain Lorraine Badoy” against Judge Marlo Magdoza-Malagar of the Manila Regional Trial Court (RTC) Branch 19.Badoy is a former spokesperson of the National Task Force to End Local Community Armed Conflict who criticized the decision of Malagar to dismiss the petition of the Department of Justice to declare the Communist Party of the Philippines (CPP)-New People’s Army (NPA) as a terrorist group.“Judge Malagar asks that all those acts of terrorism of the CPP-NPA-NDF should be considered as ‘political crimes and therefore be treated with leniency’,” a part of her post read.“So if I kill this judge and I do so out of my political belief that all allies of the CPP-NPA-NDF must be killed because there is no difference in my mind between a member of the CPP-NPA-NDF and their friends, then please be lenient with me,” she added.In a 135-page decision released by Malagar, she said the perusal of the foregoing program of the CPP-NPA showed that their organization or existence is “not for the purpose engaging in terrorism.”She said the incident allegedly committed by the CPP-NPA did not meet the stringent requirements of the Human Security Act of 2007 and that it can only qualify as incidents of rebellion.Among the basis of the decision were nine incidents, including ambush, killing and arson that were allegedly committed by the CPP-NPA.In a budget hearing, the Kabataan Partylist Representative Raoul Manuel sought for a police investigation on Badoy’s actions.Kabataan Partylist was among the many groups tagged by Badoy to have links with the CPP-NPA.
