Denver’s small vape shop owners are protesting a rushed process that limited public participation.

The Rocky Mountain Smoke Free Alliance (RMSFA) announced a boycott of the December 16, 2024, Denver City Council meeting. The Council is set to vote on an ordinance banning flavored nicotine and tobacco products.
The RMSFA, a statewide association representing 25 Denver vape shops, advocated for stricter enforcement and regulations instead of an outright flavor ban. The ordinance, if passed, will reportedly close 50 minority-owned vape stores in Denver, resulting in job losses and a $13 million reduction in annual tax revenue for the city.
RMSFA President and vape shop owner Phil Guerin expressed disappointment over the lack of consideration for small businesses. He stated that the alliance will boycott the meeting due to the council’s disregard for their input. They proposed alternatives, including special permits, increased penalties for underage sales, and mandatory ID scanners, but were largely ignored. Guerin criticized the lack of empathy shown towards small retailers and their employees, suggesting Denver voters should be concerned.
While some council members met with the RMSFA, others refused. Denver’s public testimony limitations, restricting input to 30 minutes, were criticized in comparison to the Colorado General Assembly’s more extensive hearing processes.
RMSFA member Wali Sawaged highlighted the rushed process and its impact on small businesses. He noted that businesses with no prior violations face closure without adequate opportunity for their voices to be heard. Sawaged contrasted Denver’s process with the state legislature’s more accommodating approach to public testimony.
Denver RMSFA members will urge Mayor Mike Johnston to veto the ordinance and are exploring legal challenges. They aim to prevent other Colorado localities from adopting similar measures.
